A teacher at a Christian school in Hialeah, Florida, has been arrested and charged with felony child abuse following an alleged incident involving an 8-year-old student diagnosed with autism and ADHD. Nikol Marie Rodriguez, 29, was taken into custody in early March after classroom surveillance footage reportedly captured a disturbing encounter with the special needs student under her supervision at Peace Christian Academy, which operates out of Primera Iglesia Hispana De La Biblia Abierta.
"It is a child that was acting out, and she was in the process of restraining (the child)." — Rodriguez's Defense Attorney
According to authorities, Rodriguez had been working closely with the student since August 2024. Investigators noted that while the child can follow simple instructions, he experiences difficulty expressing more complex needs. Police reports, citing CBS News Miami, indicate the child had no known history of violent behavior prior to the incident.
The alleged confrontation, which lasted several minutes, unfolded inside a classroom. Investigators allege that Rodriguez initiated physical contact by grabbing the student and pulling his arms behind his back. Authorities stated that the child did not appear to pose a physical threat at the time, contradicting claims that force was necessary to manage behavior, as reported by Local 10 News. Surveillance footage reportedly shows the situation escalating, with the child allegedly forced to the ground and restrained while appearing in visible distress as he struggled to break free.
Law & Crime reported that at one point, authorities allege the child’s upper body and head were driven into the floor while he was restrained. Police further allege that Rodriguez used both her hands and legs to keep the child pinned, at one point forcing him into a corner of the classroom. WSVN reported that another student nearby was seen covering their eyes and ears during the alleged incident. The situation reportedly concluded when the child was released and attempted to stand, at which point Rodriguez allegedly pushed him into a nearby table.
Following the incident, no medical assistance was sought, according to investigators cited by NBC Miami. The boy’s mother later reported discovering multiple injuries while preparing him for a bath, including bruising, scratches across his chest, and a puncture wound on his arm, which authorities described.
An internal report from Peace Christian Academy characterized Rodriguez’s actions as a form of “supportive de-escalation” intended to manage behavior. However, investigators contend that the surveillance footage does not support this explanation, stating instead that the child was not acting in a threatening manner prior to the restraint.
Rodriguez’s defense attorney echoed the school’s position during a court appearance, stating, "It is a child that was acting out, and she was in the process of restraining (the child)." The attorney also noted that Rodriguez has no prior arrests and intends to challenge the charge.
Rodriguez was arrested and subsequently released after posting a $5,000 bond. As part of her release conditions, she has been ordered to have no contact with the alleged victim. The case remains pending as investigators continue reviewing the classroom video and further legal proceedings are anticipated. The incident has raised questions regarding appropriate disciplinary measures and oversight, particularly concerning students with special needs in educational environments.
