House Democrats have launched an investigation into the Trump administration's handling of the prosecution of an Olympian accused of vandalizing the Lincoln Memorial Reflecting Pool, following the dismissal of charges that prosecutors now attribute to a flawed renovation. Representative Jamie Raskin (D-MD), the ranking Democrat on the House Judiciary Committee, has formally requested communications from US Attorney for the District of Columbia Jeanine Pirro and Interior Secretary Doug Burgum regarding the case.

The inquiry centers on the prosecution of David Hearn, a 67-year-old three-time Olympic canoeist, who was charged with malicious destruction of property. The felony charge, carrying a potential prison sentence of up to 10 years, stemmed from allegations that Hearn damaged the newly installed lining of the Reflecting Pool. However, federal prosecutors moved to dismiss the case late last month. Their decision cited a lack of evidence and newly disclosed Interior Department documents that provided additional information about the actual cause of the damage.
These documents indicated a significant departure from the government's initial stance. Court filings revealed that the damaged lining was the result of a "hasty" and "botched" installation. This renovation work was reportedly rushed to meet a July 4 deadline set by the Trump administration. Previously, US Attorney Pirro had maintained that prosecutors possessed "tremendous evidence" that Hearn intentionally vandalized the Reflecting Pool, causing damage exceeding $1,000. The charges were subsequently dropped after prosecutors concluded the evidence did not support continuing the case.
Representative Raskin's investigation aims to ascertain what officials within the Justice and Interior departments knew about the compromised pool lining before Hearn was charged. In letters addressed to Pirro and Burgum, Raskin posed critical questions. "Did the United States Attorney’s Office for DC in fact maliciously prosecute an American citizen it knew to be innocent with a felony charge carrying a maximum sentence of 10 years in prison?" Raskin inquired. He also questioned whether the Interior Department deliberately provided misleading information to prosecutors to conceal issues with the renovation. "Did the U.S. Department of the Interior … deliberately mislead prosecutors to cover up a ‘botched’ renovation by a company awarded a dubious $15 million insider no-bid contract?" Raskin asked. These allegations have not been established, and the inquiry is currently seeking records to determine the facts of the situation.
Further questions raised by Raskin concern the timeline of the administration's awareness of problems with the pool lining. According to court documents referenced in the inquiry, the Department of Justice (DOJ) was reportedly made aware that the newly installed lining was peeling more than a week before Hearn's arrest. Prosecutors later stated that Interior Department officials did not provide relevant evidence concerning the problem until after Hearn had already been indicted.
Democrats are seeking comprehensive communications and other records to determine if prosecutors proceeded with charges against Hearn despite possessing or having access to evidence suggesting he was not responsible for the damage. The inquiry also seeks to determine if President Donald Trump exerted any pressure on Secretary Burgum to retaliate against Hearn.
Announcing the inquiry, Representative Raskin sharply criticized the administration's handling of the case. He stated, "At a minimum, it appears that members of the Trump Administration were ready and willing to imprison an innocent American for a decade in a desperate effort to soothe an ex-landlord’s wounded ego about a terrible paint job and wasteful contract." Raskin emphasized the need for a thorough investigation, adding, "We must get to the bottom of these murky waters to rid our justice system of any and all residual contamination." The investigation is ongoing, with House Democrats committed to uncovering the full scope of events surrounding the Reflecting Pool renovation and Hearn's prosecution.
